Claim against Stellantis

What is the case about?
Fiat Chrysler was involved in the broader emission technology scandal that hit the automobile industry from 2015 onwards (“Dieselgate”). Before and during Dieselgate, Fiat Chrysler has made misleading statements and omissions regarding its compliance with emission regulations. Therefore, Fiat Chrysler did not adequately inform the investing public about its wrongful conduct. FCIRS has taken legal action in the Netherlands to recover the losses affected investors have suffered due to the unlawful actions of Fiat Chrysler.

As Stellantis is the legal successor of Fiat Chrysler, FCIRS has aimed its actions at Stellantis. 

What steps has FCIRS already taken against Stellantis?
On 10 January 2022 FCIRS sent a letter to Stellantis (the legal successor of Fiat Chrysler), holding Stellantis liable for the damages incurred by the affected investors and inviting Stellantis to enter into settlement negotiations. Stellantis did not respond to this letter. On 27 August 2024 FCIRS issued the summons to Stellantis, starting the legal proceedings before the District Court Haarlem.

Who can participate in the action?
If you bought and held common shares in Fiat Chrysler through the Mercato Telematico Azionario (MTA) stock exchange in Milan (Italy) during the period 13 October 2014 to 23 May 2017, you may have suffered a loss as a result of Fiat Chrysler’s disclosure failures and are potentially eligible to join the claim. 
What compensation am I entitled to?
At this point in time, the amount of damages that you may be entitled to is uncertain. In general, the compensation will also depend on the timing and volume of your trades. It is possible that the relevant period during which shares were purchased and held may change going forward as more information becomes available.
How long will it take to get compensation?
Litigation of this type is a lengthy process and it may take several years to obtain a final decision in the legal proceedings against Stellantis or negotiate a settlement.
Who is claiming damages from Fiat Chrysler on behalf of investors?
Fiat Chrysler Investors Recovery Stichting, also referred to as FCIRS or the Foundation. FCIRS is an independent Dutch foundation that has initiated legal proceedings against Stellantis before the District Court of Amsterdam. It is still possible to join the action by registering here.

What does it cost to participate?
Signing up costs you nothing. A “no cure, no pay” agreement applies to the legal action. Only if the case is successful will a share of the compensation be due to the funder. See ‘How does Fortress Investment Group LLC get paid for the funding?'.
How does Fortress Investment Group LLC get paid for the funding?
FCIRS' class action is funded by CF Bronze Ltd which is associated with Fortress Investment Group LLC and has agreed to provide the funds for the legal proceedings against Stellantis (the “Funder”). If the claim is successful, (i) the Funder will be reimbursed for the advanced costs and (ii) the Funder will be entitled to a success fee of up to 25% of the total proceeds in respect of the remaining proceeds. If the lawsuit is unsuccessful, the investors will not be liable for the legal fees incurred.

Fiat Chrysler Investors Recovery Stichting ("FCIRS") is a Netherlands-based non-profit class action foundation. FCIRS has initiated legal action to safeguard the interests of retail and institutional investors in Fiat Chrysler who have been harmed by its unlawful actions.
What is the purpose of the Fiat Chrysler Investors Recovery Stichting?
Fiat Chrysler Investors Recovery Stichting represents the interests of affected institutional and retail investors in Fiat Chrysler to recover the losses suffered due to the unlawful actions of Fiat Chrysler.

How are the FCIRS's board members paid?
The members of the Management Board and the Supervisory Board are paid on an hourly basis (EUR 275) for their services to FCIRS. FCIRS will publish annually the amount of fees and expenses that have been incurred by the members of the Management Board and the Supervisory Board. FCIRS’s board members do not have a personal financial interest in the outcome of the action.
